Aware of the importance of the protection and good management of the personal information provided to the owners of the information, EXECUTIVE TRAVEL - AGENCIA COLOMBIA VIAJES and its brand OnlyCabo Tours, hereinafter OnlyCabo Tours, who acts as responsible for the information received, has designed this policy and procedures that together allow appropriate use of your personal data.
In accordance with the provisions of article 15 of the Political Constitution of Colombia, which develops the fundamental right to habeas data, referring to the right that all citizens have to know, update, and rectify the personal data that exists about them in databases and in files of both public and private databases. Said right has been developed through the issuance of Statutory Law 1581 of 2012 and Regulatory Decree 1377 of 2013, based on which OnlyCabo Tours, as RESPONSIBLE for the personal data, receives, manages and processes the information and thus proceeds to issue this personal data processing policy.
With the implementation of this policy, it is intended to guarantee the confidentiality of information and the security of the treatment that will be given to it to all clients, suppliers, employees and third parties from whom OnlyCabo Tours has legally obtained information and personal data in accordance with the guidelines established by the law regulating the right to Habeas Data. Likewise, through the issuance of this policy, the provisions of literal K of article 17 of the aforementioned law are complied with.
Authorization: Prior, express and informed consent of the data owner to carry out the treatment.
Database: The organized set of Personal Data that is subject to processing, electronic or not.
Personal data: Any information linked or that can be associated with one or several specific or determinable natural persons.
Sensitive personal data: Information that affects the privacy of the person or whose improper use can generate discrimination, such as those that reveal racial or ethnic origin, political orientation, religious or philosophical convictions, data related to health, sexual life and biometric data.
Responsible for the Treatment: Person who, by themselves or in association with others, decides on the database and/or the processing of the data.
Data Processor: Person who processes data on behalf of the data controller.
Owner of the data: The natural person to whom the information refers.
Processing: Any operation or set of operations on personal data such as collection, storage, use, circulation or deletion.
Transmission: Processing of personal data that involves the communication of the same within or outside Colombia.
Transfer: The transfer of data takes place when the person responsible sends the information or personal data to a recipient located inside or outside the country.
Principle of legality: Data processing must be subject to the provisions of the law.
Principle of purpose: The treatment must obey a legitimate purpose in accordance with the Constitution and the Law.
Principle of freedom: Treatment can only be carried out with the prior, express and informed consent of the owner.
Principle of truthfulness: The information subject to processing must be truthful, complete, exact, updated, verifiable and understandable.
Principle of transparency: The right of the owner to obtain information about the existence of data that concerns him must be guaranteed at any time.
Principle of restricted access: The processing is subject to the limits that derive from the nature of the personal data and the provisions of the law.
Security principle: The information must be handled with the technical, human and administrative measures necessary to provide security to the records.
Principle of confidentiality: All persons involved in the processing of personal data are obliged to guarantee the confidentiality of the information.
Information collected: Names and surnames, identification, gender, marital status, date of birth, email, financial data, travel preferences, contact information for emergencies, and trip information including destination, dates, number of travelers, and budget.
OnlyCabo Tours informs the owners that the data collected may be used for the following purposes:
Authorization will be obtained through any means subject to subsequent consultation, such as the website, forms, in-person activities or social networks. Since Cabo San LucasGroup.com belongs to Executive Travel, your personal information may be shared with group companies, business partners and third-party suppliers.
OnlyCabo Tours may transfer data to other Data Controllers when authorized by the owner of the information or by law or by an administrative or judicial order. OnlyCabo Tours may send or transmit data to managers located inside or outside the Republic of Colombia when it has authorization from the owner or when there exists a data transmission contract.
Duties of the Data Controller: Guarantee the full exercise of habeas data rights, keep authorization copies, inform about the purpose of collection, maintain information security, process queries and claims, adopt internal manuals, inform about data use, and comply with Superintendency instructions.
Duties of Data Processors: Guarantee habeas data rights, maintain information security, timely update or delete data, process queries and claims, adopt internal manuals, allow access only to authorized persons, and comply with Superintendency instructions.
For receiving requests, complaints and queries related to personal data, OnlyCabo Tours has designated info@onlycabotours.com.
Queries: Will be answered within a maximum of ten (10) business days from receipt. If not possible, the interested party will be informed, with a maximum extension of five (5) additional business days.
Claims: Must include identification of the owner, description of facts, address, and supporting documents. If incomplete, OnlyCabo Tours will require corrections within five (5) days. The maximum term to address claims is fifteen (15) business days, with a possible extension of eight (8) additional business days.
OnlyCabo Tours reserves the right to modify this policy to adapt it to legislative or jurisprudential developments. In such cases, OnlyCabo Tours will announce changes with reasonable advance notice.
